BUYER PROTECTION POLICY

1. What is the Buyer Protection Policy?

When you make a purchase, you are protected by this Buyer Protection Policy. There is no cost to use our Buyer Protection Policy and no fees are associated with it. In order to stay true to the course, we have found a better alternative to Escrow which involves hiring a third party mediator. That means we will seek the intervention of the third party mediator in the event the issue cannot be solved within our internal dispute team.

Our Buyer Protection Policy is not a warranty, guarantee or insurance. It is just a mechanism by which we ensure your financial interests are well taken care of as you get value for your money.

2. What does the Buyer Protection Policy cover and not cover?

This Buyer Protection Policy allows you to make a claim if you make an eligible purchase and one of the following two things happens. You cannot make a claim for anything else:

• what you purchased is not delivered; or
• what you purchased was delivered to you but was materially different to what you were told it would be.

As you are aware, the work on Sunstone Digital Tech is done in phases which always need your approval. Through each phase you will receive an email confirmation. In the event you have a dispute it will be in reference to a particular phase thus making you entitled to a certain percentage of refund. This based on the fact that Sunstone Digital Tech Inc offers services that are digital in nature.

3. Disputes

Sunstone Digital Tech Inc encourages its users to try and resolve any disagreements through it. However, should that not be possible Sunstone Digital Tech Inc can provide Dispute resolution services through a third party mediator.

Sunstone Digital Tech Inc will aim to make a resolution decision on behalf of both parties within seven (7) days. If a mutual resolution is accepted between both parties, then the dispute will either be cancelled and not be escalated to the third party mediator.

4. Warranty Disclaimer

The services are provided by Sunstone Digital Tech Inc “as is”, “as available” and without warranty of any kind, express or implied, including, but not limited to, the implied warranties of non-infringement, merchantability and fitness for a particular purpose, and any warranties implied by any course of performance or usage of trade, all of which are expressly disclaimed by Sunstone Digital Tech. Sunstone Digital Tech Inc, does not warrant that: (i) the services will be secure or available at any particular time or location; (ii) any defects or errors will be corrected; (iii) any content or software available at or through the services is free of viruses or other harmful components.

5. Limitation of Liability

In no event shall Sunstone Digital Tech Inc be liable under contract, tort, strict liability, negligence or any other legal or equitable theory with respect to the services.

6. Force Majeure

Sunstone Digital Tech Inc shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond its reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation.

BY ACCESSING OR OTHERWISE USING THE SERVICES, YOU HEREBY REPRESENT AND WARRANT THAT YOU ARE DULY AUTHORIZED TO ENTER INTO THIS AGREEMENT.
